I. Definition of terms
1. The site is the website of the Charitable Organization "Kvyatkovsky Family Foundation", which is located at the address: created to host electronic (digital) information (other objects of copyright and (or) related rights, etc.) for the purpose dissemination of information about the Fund's projects and programs, as well as about partners and cooperation with them.
The owner of the Site is the Foundation.
2. Foundation — Charitable organization "Kvyatkovskyy Family Foundation".

3. Terms of use — this document, which establishes the principles and conditions of the Site's operation and use, the rights and obligations of the Users, as well as the rights and obligations of the Foundation.
4. User is a natural person, a legal entity, as well as an organization that is not a legal entity that uses the Site in any way.
5. A benefactor is a legally competent natural person or legal entity under private law who make charitable contributions for the benefit of the Fund, which the latter uses in accordance with the terms of the Meeting or in accordance with the Charter.
6. Beneficiary is a person in need of assistance, in whose interests the Foundation can organize a Collection for the purpose of assistance, and to whom the Foundation provides charitable assistance from the amount of Donations.
7. Donation is a charitable donation within the meaning of the provisions of the Civil Code of Ukraine and the Law of Ukraine "On Charitable Activities and Charitable Organizations", which the User provides to the Foundation.
8. Collection is a collection of funds that the Foundation announces on the Site to achieve a specified goal, or for the Foundation's statutory goals in a broad sense.
II. Terms
1. The site is the exclusive property of the Foundation.
2. The Fund provides Users with an e-mail address: fond.kff@gmail.com — intended for communication with it, to which Users can send any questions, suggestions, comments and information to the Fund.
3. Each mention in the context of the Terms, information or any other form of contact with the Fund should be understood as sending a message to the electronic address (e-mail) specified in the previous paragraph.
4. Use of the Site is voluntary and free of charge. The user guarantees that when using the Site, he does not and will not take any actions aimed at bypassing technical means of protection against unauthorized use of the Site, viewing/listening, copying Materials, as well as any other actions aimed at changing functional characteristics, destabilization of the Site.
5. Each User of the Site is obliged to familiarize himself with the Terms and express his consent to their content. By using the Site, the User confirms that he has read the Terms, understands their content and undertakes to comply with these Terms in full.
6. The logo and name of the Site are protected by law and are the property of the Foundation. It is prohibited to use the logo or the name of the Site in any way without the consent of the Foundation, except for situations provided for by the provisions of current legislation.
7. Copyrights to the graphic elements of the Site and other elements of it, which the Foundation has placed, as well as to access to all the content of the Site belong exclusively to the Foundation and third parties with whom the Foundation has concluded relevant license agreements. Any copying, duplication and distribution of elements of the Site, as well as access to the full content of the Site without the consent of the Foundation, is prohibited.
The user who submits to the Foundation for placement on the Site:
- own image, gives consent that his photo image, individual frames (parts), as well as his name will be used, publicly displayed and distributed by the Foundation;
- image of a third person, must have the consent of this person to distribute his image for placement on the Site.
If this person does not have full legal capacity, consent is given by his legal representative.
The territory to which such consent is extended is the territory of all countries of the world, without limitations (including the territory of Ukraine). The term of consent is unlimited.
9. The Foundation has the right to apply any measures that do not contradict the current legislation, in order to prevent unauthorized access to the Site, destabilize the operation of the Site and other actions that may violate the rights and legitimate interests of the Site, the Foundation and/or the rights holders of the Materials.
III. Collection and transfer of Donations
1. Meetings on the Site are published exclusively by the Foundation. The Fund can hold meetings both for the Statutory purposes (for the implementation of programs, projects, etc.), and on behalf and for the benefit of the Beneficiary.
2. Donations are non-refundable except in situations provided for by law.
3. Benefactors can transfer Donations using Financial Intermediation Services or by making a transfer to the Fund's bank account.
4. Any complaints related to the transfer of Donations will be considered in accordance with the procedure provided for in the Complaints section.
5. Settlements of transactions related to transfers of Donations by wire transfer, with the exception of transfers made directly to the Fund's account, take place through the settlement center of the Financial Intermediation Service. The Fund is not responsible for payment data processed by the Financial Intermediation Service.
6. The total amount of Donations transferred by Benefactors to the Collection is published on the Site, while this amount is approximate and may differ from the total amount of Donations transferred due to possible interruptions in the work of the banking system or due to incidents with a lack of response payment system, etc.
Reports on the use of charitable donations are prepared by the Foundation annually by the end of February for the reporting year and are published on the Site.
7. The Benefactor can transfer Donations anonymously.
IV. Donations for persons in whose interests the Collection is organized, duties of the Foundation
1. The Foundation can organize fund-raising for the benefit of the Beneficiary by posting information about the Beneficiary on its official website, mass media, social networks and conducting charity events, involving third parties, without territorial limitations. At the same time, the Fund independently determines the texts, forms and methods of the fund-raising campaign in favor of the Beneficiary, without falsifying any information about him.
Funds collected within the framework of the Meeting are used by the Fund in accordance with the purpose declared during the Meeting.
The amount of the donation may be reduced by the amount of Donations for which the Benefactor is obligated to return.
2. If it is impossible to achieve the purpose of the Meeting for reasons beyond the control of the Foundation, it will immediately determine another purpose for which the amount of the Donation will be allocated, exclusively in accordance with the provisions of the Statute.
3. After the Collection, the Foundation publishes a report on the results of the public collection of charitable donations on the Site.
4. Other information related to the Meeting is posted on the Site, if the User requested the Foundation to publish this information.
5. The Fund has the right to stop the collection in favor of the Beneficiary in the case of providing inaccurate information, lack of communication and communication with the representatives of the Fund, in case of death of the Beneficiary, etc.
The Beneficiary has the right unilaterally to refuse to receive a Donation or to collect funds by submitting a written statement to the Fund.
6. In the cases referred to in clause 5, the funds collected at the time of termination of the Meeting are used for the purposes specified in the Foundation's Charter.
V. Applications of persons who need support
1. Each User can declare the need for help in connection with a serious health condition or a difficult life situation by sending an application to the email address: fond.kff@gmail.com
2. Applications are considered in the sequence of their registration by the Fund. If the application is approved by the Foundation, you will need to write a statement on the provision of charitable assistance and, if necessary, conclude an Agreement with the Foundation.
3. The Fund, upon accepting the application, including after analyzing the information attached to the application (medical documentation, IDP certificates, etc.) and the estimate, will consider the possibility of providing charitable assistance to such a person or regarding the announcement on the website of the Meeting for the person. The Foundation sends a decision to announce or refuse to announce the Meeting by notification (e-mail), if the Foundation does not leave the application without a response.
4. The Fund may leave the application unanswered without giving a reason.
5. The Fund does not guarantee receiving the necessary assistance in full and within the specified time, as it depends on the charitable donations provided by Benefactors and the queue of Beneficiaries applying for assistance.
VI. Volunteers
1. If you wish to help the Beneficiaries of the Fund, you can become a volunteer of the Fund.
2. In order to become a volunteer of the Foundation, fill out the questionnaire posted on the Site.
A representative of the Foundation will contact you using the specified contact details and tell you how and when you can help the Foundation in charitable activities. At your request, the Foundation concludes an appropriate agreement on the implementation of volunteer activities.
Persons who have not reached the age of 18 can become a volunteer of the Foundation, provided that their parents / legal representatives give written consent to carry out volunteer activities for the benefit of the Foundation.
VII. Personal data
All information related to the Fund's processing of Users' personal data is placed in a separate document - "Privacy Policy".
VIII. Complaints
1. Each User has the right to file a complaint regarding the operation of the Site, as well as the performance of duties by the Foundation.
2. Complaints must be sent to the Fund's e-mail: fond.kff@gmail.com, indicating the subject "Complaint" or in writing.
3. The Fund will respond to the complaint within 30 days from the day of its receipt.
4. The response to the complaint will be sent to the User to the e-mail address (e-mail) that was specified in the complaint, and if the complaint was submitted in writing - to the e-mail address (e-mail) that was specified in the letter, or in writing to the address specified in the letter.
5. The Fund declares that complaints related to services provided by third parties, including those provided by Financial Intermediation Services, are considered by these third parties in accordance with the conditions and in the manner provided for in the rules for the provision of services by these persons.
IX. Changes in the Rules
1. The Fund reserves the right, at its discretion, to change, correct, add or delete parts of these Terms and Conditions by posting an updated version on the Site. The User's continued use of the Site after making changes and/or additions to these Terms means the User's acceptance and agreement with such changes and/or additions.
These rules, as well as changes to them, enter into force from the moment they are posted on the Site.
2. All legal relations not regulated by the Rules are governed by the current legislation of Ukraine.
